How do I get an annulment when the person I married was not divorced from his previous marriage?

I got married in May 2016 in Pennsylvania (where I’m originally from.) We got the marriage certificate in the county where the ceremony was (Monroe County, PA) at the advice of the ceremony vendor. They asked if he was currently married and he said no. One year after the wedding (June 2017), while we were living in Virginia, he decided he didn’t want to be married anymore and also revealed that he never got a divorce from his marriage before me, his second marriage, which was in Virginia. I then moved to Washington, DC to be closer to my job. I consulted a lawyer in PA and he said he could take my case. It took over two years to file for an annulment, and it was ultimately dismissed because I was not a domicile of PA. I would like to file for annulment or some sort of order that the marriage is void since I don’t believe this marriage should be valid considering he was still married in another state. Someone please help!

Being already married is one of the legal elements under the DC annulment statute, however, your case is a bit more complicated given the jurisdictional issues and also the length of the marriage. Would suggest reviewing our DC Divorce page and making an appointment to discuss the specifics of your case.

Prenup’s effect on a marriage green card case?

I’m on a working visa and plan to marry my US citizen fiance, we have been together almost two years. Since his salary is three times of mine, my fiance suggest to sign a prenup that our finance will be separately even after marriage. I have no objection to sign the prenup, but I do plan to apply family based green card after marriage. My question is will this prenup influence my family-based immigration case?

Prenuptial agreements should not influence your immigration status as they are contract based and deal specifically with property. However if there are any clauses dealing with the immigration status post marriage, then, a closer review of those clauses are advisable.

Refer to our prenuptial agreement page for more information on this subject:
